GENERAL TERMS AND CONDITIONS (VOP)

ARTICLE 1: INTRODUCTORY PROVISIONS AND DEFINITIONS

1.1 These General Terms and Conditions ("Terms") govern the rights and obligations between the Seller and the Buyer arising from or related to the purchase of goods via the e-commerce platform hosted on the website www.warcopy.com.

1.2 The main purpose of the web platform and its production is to support and develop the historical activities of Max Work s.r.o. The website is intended for enthusiasts of military history, collectors, and reenactment groups interested in objects from the Second World War.

1.4 The Buyer: Any natural or legal person who places an order on the website.

  • Consumer: A natural person who does not act within the scope of their business or entrepreneurial activity.
  • Merchant/Entrepreneur: A person acting within their business activity (must provide their company billing details/ID).

1.5 When registering on the website and ordering goods, the Buyer is strictly obliged to provide correct, accurate, and truthful information. The Buyer must update this data in their user account upon any change. Data provided by the Buyer during the ordering process is considered correct by the Seller.

1.6 All correspondence from the Seller will be delivered to the Buyer at the email address specified in the customer's account or order details.


ARTICLE 2: TAKING ORDERS AND CONTRACT FORMATION

2.1 The presentation of goods on the website is informative. The Buyer places an order by completing the checkout process on the website.

2.2 The Seller reserves the right to accept or NOT accept orders from certain countries. Furthermore, if for any reason (including, but not limited to, goods being unavailable or production constraints), the Seller decides not to accept an order, the Buyer will be advised accordingly via email, and any money paid will be fully refunded.

2.3 Please note that the initial automated acknowledgment of the order does not constitute acceptance of that order. Similarly, receiving a payment acknowledgment email from PayPal or a bank transfer notification does not constitute formal acceptance of the order.

2.4 Contract Formation: No binding contract will exist between the Seller and the Buyer until the Seller has received full payment from the Buyer, confirmed the order, and dispatched the ordered items. A binding order consists of the Buyer receiving an official invoice for a paid order, sent to the given contact email.


ARTICLE 3: PRICES, PAYMENT METHODS, AND TERMS

3.1 All prices on the website are displayed in Euros. Normally, ALL payments must be received in EUROS (€).

3.2 Any transaction fees, conversion charges, or banking fees required by specific payment methods or cross-border transfers must be fully covered by the Buyer.

3.3 The Buyer can execute payment by:

  • Bank Transfer (utilizing IBAN & BIC details provided in the order confirmation).
  • Transfer to PayPal account.

3.4 When ordering an item, it is assumed the Buyer has the funds available. The complete payment (comprising items, shipping costs, and any other associated charges) must be received within the following deadlines:

  • For payments via Bank Transfer: within 5 working days from the date of the order.
  • For payments via PayPal: within 3 calendar days from the date of the order.

3.5 If the payment is not received within the respective deadline specified in point 3.4 and no written update or notice is provided by the Buyer, the order will be automatically canceled.

3.6 Ownership of the Goods passes to the Buyer only after full payment of the Total Price and subsequent delivery of the Goods.


ARTICLE 4: SHIPPING, EXPEDITION, AND DELIVERY TERMS

4.1 All items are normally shipped from Slovakia.

4.2 Expedition Schedule: Orders are shipped strictly once a week, on Wednesday. In order for a shipment to be dispatched on Wednesday, the order must be fully placed, accepted, and paid by 5:00 AM (CET, Slovak time) on that specific Wednesday. Payments cleared and orders received after 5:00 AM will be automatically queued for the following week's Wednesday expedition.

4.3 Delivery Times: Delivery time limits apply from when the parcel is actually sent, not from the date when the item was ordered. Estimated transport durations are:

  • Slovakia: 2 business days.
  • Europe: From 1 to 3 weeks.
  • Australia and New Zealand: From 3 to 4 weeks.

4.4 Seasonal Delays: During Christmas time or the New Year period, international transit times fluctuate significantly; a parcel may be delayed by a week or even a month. Production times can also be extended during peak seasons. Buyers are advised to place orders well in advance.

4.5 Tracking: The Seller will email the Buyer with a tracking number the same day the parcel is dispatched. If the parcel is not received within the delivery limits shown above, the Buyer should contact the Seller to initiate a status check.


ARTICLE 5: CUSTOMS, LAWS, AND RISK TRANSFER

5.1 The Buyer is fully responsible for knowing and verifying their own country's laws, regulations, and import restrictions regarding the purchased items before placing an order. Items are sent entirely at the customer's own risk regarding regulatory compliance.

5.2 Loss in Transit: Once the parcel has legally left the hands of the Seller and is handed over to the postal or courier carrier, the Seller does NOT take responsibility for loss in transit. The Seller cannot be held responsible for operational errors, delays, or actions done by third-party postal services or cross-border authorities in foreign countries. This must be taken into consideration when issuing payments via PayPal or other processors.

5.3 Customs Action: Packages may be set aside, refused, or officially destroyed by customs authorities in various destination countries. If a shipment is destroyed or refused delivery by official customs border actions, the Seller will NOT take any responsibility, and the order cannot be refunded.

5.4 Returned Shipments: If an item is officially rejected by border authorities and successfully returned undamaged to the Seller because it cannot be imported into the destination country, the Seller will refund the amount received, less any shipping costs, return costs, and transaction fees incurred by the Seller. If the shipment is officially destroyed, no refund will be provided.


ARTICLE 6: ORDER CANCELLATION, RETURNS, AND REFUNDS (CONSUMER RIGHTS)

6.1 Right to Withdraw: If the Buyer is a Consumer, they have the right to withdraw from the contract without giving any reason within 14 days from the day of receipt of the goods, in accordance with the consumer protection legislation of the Slovak Republic (Act No. 108/2024 Coll.).

6.2 Online Withdrawal Method: To exercise the right of withdrawal easily, the Consumer can use the dedicated electronic return form/button. This option is accessible:

  • Via the direct link included in the initial automated order confirmation email, which redirects to the order details.
  • Via the website footer menu under the section "My Order", or directly at www.warcopy.com/my-order/, after entering the order number and the customer's email address.

6.3 Once the Consumer submits the withdrawal using this online form, the Seller will immediately send an automated acknowledgment of receipt of such a withdrawal via email. If the Consumer chooses not to use this system, they must explicitly notify the Seller via email (info@warcopy.com) within the 14-day period, otherwise the item will be considered definitively sold.

6.4 Return Shipping: The Consumer must return the item in the exact same condition as sent (undamaged, unused, unaltered). The Consumer must use a monitored (tracked) type of transport with a mandatory delivery confirmation. The Seller is not responsible for returned items lost in transit. All re-delivery costs, postage, and transaction fees for returning the order are borne entirely by the Buyer and are non-refundable.

6.5 Refund Execution: All approved refunds will be processed without undue delay, and no later than 14 days from the day on which the Seller is informed of the Consumer's decision to withdraw from the contract. However, the Seller may withhold the refund until the goods are received back or until the Consumer supplies evidence of having sent back the goods. Refunds will be issued strictly in the same form as the original payment.


ARTICLE 7: INTENDED USE OF GOODS (EXCLUSION OF WEAR WARRANTY)

7.1 The Seller offers historical replicas, gear, clothing, footwear, and headgear for collector's display purposes only.

7.2 These items are historical collectible props and are not manufactured or intended for actual routine wear, daily usage, or functional modern apparel wear.

7.3 The Seller does not guarantee the exact physical fitting, sizing, or alignment of any clothing, footwear, or headgear on a living person or on a specific mannequin, nor do we warrant their suitability or durability for being worn in field scenarios.


ARTICLE 8: DELIVERY OF WRONG GOODS

8.1 If the Buyer receives an incorrect item (an item other than what was ordered), they must contact the Seller immediately via email and provide a clear photograph of the wrong item.

8.2 Upon validation of the error, the Seller will dispatch the correct item. The shipping cost for the correct item will be fully paid by the Seller.

8.3 The Buyer is entitled to keep the incorrectly sent item as a gift; it does not need to be returned to the Seller.


ARTICLE 9: LEGAL DISCLAIMER REGARDING SYMBOLISM AND EXTREMISM

9.1 The Warcopy store stocks and produces historical replicas that contain the swastika, SS runes, ríšska orlica (Imperial Eagle), and other World War II symbols. These products are intended strictly and exclusively for collectors, military history reenactment groups, theatrical plays, educational displays, and film/documentary productions.

9.2 The products, production, and this website do not serve, under any circumstances, to promote, glorify, or propagate extremist movements, neo-Nazism, fascism, racism, or ideologies that lead to the suppression of human rights and freedoms of an individual or a group of people. WARCOPY strictly and completely dissociates itself from extremist movements, radical organizations, and hate ideas of any direction!

9.3 By purchasing from this website and explicitly agreeing to these Terms and Conditions during checkout, the Buyer honestly and legally declares under penalty of law:

  • That they are not a member or a sympathizer of any extremist movement, hate group, or illegal radical organization.
  • That they will not misuse these historical products in any way to support, promote, display publicly out of context, or facilitate the promotion of movements aimed at suppressing basic human rights and freedoms.

ARTICLE 10: GOVERNING LAW AND ODR

10.1 These Terms and Conditions and all purchase contracts entered into with Max Work s.r.o. are governed by and construed in accordance with the laws of the Slovak Republic, without regard to conflict of law principles.

10.2 European Consumers also have the right to use the European Online Dispute Resolution (ODR) platform to resolve any dispute out of court at: https://ec.europa.eu/consumers/odr/.
